KERNOW: DEVON & CORNWALL POLICE - IPCC RESPONSE

The IPCC have responded to the Celtic League General Secretary, Rhisiart Tal-e-bot, following his reference to them of concerns about the Devon and Cornwall Police Force (see below)

Dear Mr Tal-e-bot

I write with reference to your letter of 18th January 2008 to Chief Constable Stephen Otter. I apologise for my delayed response; this is because I have only recently returned from a period of leave.

I am advised by the Devon and Cornwall Constabulary Professional Standards and Performance Department that the matters to which you refer were brought to their attention some time ago.

These have been classed as 'direction and control' complaints – namely complaints that relate to operational policing policy or organisational decisions rather than to any suspected misconduct – and are being dealt with by Chief Inspector Meakin under the reference PSD/QU/48/07.

Should the people concerned feel that any officer has been guilty of misconduct, and thus that the matters in question should have been recorded as complaints against police under the terms of the Police Reform Act 2002, they have the right to appeal to us against the recording decision by the Constabulary. I have attached a copy of the relevant appeal form for your information.

Please note that for the purposes of the Act, a complaint may only be made by someone who is subject of or witness to the alleged misconduct; who could be considered to have been 'adversely affected' by it; or anyone who has been appointed by that person to act on their behalf.
